China (PRC): 2023 SPC Cases: SIEMENS - Defendant’s deliberate refusal to provide its financial information resulted in a damage award of RMB 100 million to the German plaintiff

In one of the Top 10 Cases published by the PRC Supreme Court for 2023, SIEMENS was awarded 100 million RMB (approximately 15 million USD) in a trademark infringement and unfair competition case.

China (PRC): China Introduces Revised Cross-border Data Transfer Rules

On March 22, 2024, the “Regulation on Promoting and Regulating Cross-Border Data Flows” (“Final CBDT Regulation”) was published and became effective.

The second edition of guidelines for filing standard contracts (“China SCC”) and for filing applications for security assessment with the CAC (“CAC Security Assessment”) were also issued.

China (PRC):  2022 SPC Cases - Cartier vs. Manufacturer and Seller of Infringing products

If the franchisor and the franchisee appear to be unified, and the franchising parties have a close relationship of interest, and the franchise contract stipulates the franchisor’s right to supervise and manage the franchisee’s business activities, then the franchisor shall be jointly and severally liable for any damage and further damages caused by the franchisee’s activities due to franchisor’s negligence in supervision and management.
