Trademark Registration

Depending on client’s needs, we conduct “knock-out” and / or comprehensive availability searches and provide practical analysis with specific recommendations on overcoming potential conflicts. Our analysis is not based solely on the search results, but also the actual use (if any) of the revealed conflicts and the background of their owners, for better assessment of the citation and infringement risks and then the client’s options.

Trademark Registration

We do not treat trademark filings as simple routine matters. We counsel client on the best form of the mark to file for, the ideal Chinese language mark with cultural considerations, the core goods/services to cover given the unique “subclass” system adopted by the PRC Trademark Office, and any additional goods/services for consideration, based on our understanding of the local business environment.

Trademark Portfolio Audits and Management

For existing clients, we provide regular portfolio management and updating of their database (if needed). For new clients, we will conduct audits of their portfolios for coverage of their existing marks with comments on possible filing gaps.

 

Watch Services

We monitor the local register on a regular basis for marks that could be of concern to client. Once such mark is identified, we provide our clients advice on possible actions, including protest letter, opposition, C&D letters and / or investigations. Our watch services are particularly useful when it comes to Chinese-language marks as they are often overlooked or misidentified by other commercial watch services currently available on the market.

Enforcement

Online investigations are handled by our dedicated in-house team, and on-site investigation are handled by outside investigation firms selected with work quality and compliance considerations, based on over 15 years of working experience with investigators.

Enforcement Actions

We assist clients in protecting and enforcing their IP rights with all possible options, including administrative, criminal and / or civil actions, as well as specific enforcement campaigns often organized by local authorities. We maintain good working relationships with all major e-commerce and social media platforms in China and are in regular contact with them on behalf of clients.
